This Legal Notice governs the access to and use of the website riderrank.com (hereinafter referred to as the Platform), as well as all its subdomains and dependent pages. The Platform is a digital community for motorcyclists that enables the uploading of routes in GPX format, participation in a rank and mission system based on mileage covered, and the purchase of physical merchandise through the integrated shop at shop.riderrank.com.

Access to and use of the Platform implies full acceptance of this Legal Notice, the Terms of Service, the Privacy Policy, and the Cookie Policy, all available at riderrank.com.

3. Intellectual Property

The trading name RiderRank, logo, visual identity, ranking and mission systems, scoring algorithm, badge artwork, patch designs, and all non-user-generated content are the exclusive intellectual property of the operator or have been licensed to the operator, and are protected under Spanish Royal Legislative Decree 1/1996 on Intellectual Property and applicable trade mark law.

Reproduction, distribution, public communication, transformation, or any other form of exploitation of Platform content — in whole or in part — is strictly prohibited without prior written authorisation from the operator, except as expressly permitted by law or by the Terms of Service.

User-generated content (GPX files, photographs, route descriptions) remains the property of the respective authors as set out in the Terms of Service. The operator assumes no liability for any infringement of third-party rights arising from user-uploaded content.

4. Conditions of Use

Users agree to use the Platform in accordance with applicable law, this Legal Notice, and the Terms of Service, and not to use it for unlawful activities or activities that may cause harm to third parties. The following are expressly prohibited:

Accessing or attempting to access restricted areas without authorisation.

Uploading or transmitting content that infringes third-party intellectual property or privacy rights.

Using automated tools (bots, scrapers, crawlers) to extract data from the Platform.

Manipulating route data or the ranking system through GPS spoofing or any other fraudulent means.

Transmitting computer viruses or any harmful code.

5. Limitation of Liability

5.1 User-Generated Content

The Platform acts as a hosting intermediary under Article 16 of Spanish Law 34/2002 (LSSI-CE) and Article 6 of EU Regulation 2022/2065 (Digital Services Act). The operator does not pre-screen user-uploaded content and assumes no liability for its accuracy, legality, or suitability. Upon receipt of a valid notice of illegal or infringing content at legal@riderrank.com, the operator will act diligently to remove or disable access to it.

5.2 Motorcycling Activity

Information on the Platform, including GPX route files and route descriptions, is provided for informational purposes only and does not constitute professional advice of any kind. Motorcycling is an activity that carries inherent risks. The operator assumes no liability for accidents, personal injury, property damage, administrative penalties, or any other consequence arising from use of the information available on the Platform.

5.3 Service Availability

The operator does not guarantee continuous, uninterrupted availability of the Platform and reserves the right to suspend, modify, or discontinue it at any time, without notice and without liability to users.

5.4 Third-Party Links

The Platform may contain links to third-party websites. The operator does not control and assumes no responsibility for the content, privacy policies, or practices of those sites. The inclusion of a link does not imply endorsement by the operator.

6. Personal Data Protection

The processing of users' personal data is governed by the Privacy Policy of RiderRank, prepared in accordance with EU Regulation 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

Users may exercise their rights of access, rectification, erasure, objection, restriction, and portability by contacting the operator at the above address with the subject line GDPR Rights Request. 9. Governing Law and Jurisdiction

This Legal Notice is governed by the laws of the Kingdom of Spain. For the resolution of any dispute arising from access to or use of the Platform, the parties submit to the jurisdiction of the Courts and Tribunals of Madrid, Spain, without prejudice to the rights that EU consumer protection law grants to consumers to bring proceedings before the courts of their country of habitual residence.

The operator reserves the right to update this Legal Notice at any time. Updates take effect upon publication on the Platform. Users are advised to review this Legal Notice periodically.
